Terms & Conditions

These terms set out the basis on which Pensara provides its document organisation and pension information sessions to clients. Please read them at your own pace before making use of our services.

1. Definitions

Agreement
These Terms & Conditions, together with any written booking confirmation, form the complete agreement between you and Pensara.
We / Us / Our
Pensara, operating from 64 Huay Kaew Road, Chang Phueak, Muang, Chiang Mai 50300, Thailand.
You / Client
Any individual aged 18 or over who books or attends a Pensara session, or who uses this website.
Services
The document organisation sessions and pension information programmes described on this website, offered for educational and organisational purposes only.
Content
All text, printed materials, checklists, summaries, and reference notes provided by Pensara during a session or via this website.
Session Materials
Printed checklists, plain glossaries, filing guides, and family briefing documents prepared specifically for a client or group.

2. Acceptance of Terms

By booking a session, attending a programme, or using this website, you confirm that you have read and understood these terms and that you agree to be bound by them.

You must be at least 18 years old and have the legal capacity to enter into this agreement. If you are booking on behalf of a household or another person, you confirm that you have the authority to do so and that the other person has been informed of these terms.

If you do not agree with any part of these terms, please do not book a session or use this website.

3. Our Services

Pensara offers three organisational and informational services to people approaching or in retirement:

  • Document Checklist Walkthrough — a one-to-one session helping you organise and label personal records, with a printed checklist.
  • Group Learning Sessions on Retirement Basics — small-group sessions explaining how common retirement-related paperwork generally fits together, with printed summaries.
  • Household Records Organisation Programme — a multi-session programme to help a household create an orderly set of records and a family briefing document.

All services are organisational and informational only. We do not provide financial, legal, tax, or investment advice. For matters requiring formal guidance, we will point you to the relevant official bodies.

Services are offered in person at our Chiang Mai office or at agreed locations in the Chiang Mai area. Remote sessions may be arranged at our discretion. Sessions are conducted in English; other language arrangements may be discussed in advance.

Session dates and times are subject to availability. We will confirm bookings in writing.

4. Bookings & Payments

4.1 Booking

A booking is confirmed once we send you a written confirmation by email. We reserve the right to decline a booking for any reason, in which case any payment received will be returned in full.

4.2 Pricing

All prices are quoted in Thai Baht (฿) and include applicable taxes unless stated otherwise. Current prices are displayed on our website and in booking confirmations. Prices may change from time to time; any change will not affect confirmed bookings.

  • Document Checklist Walkthrough: ฿4,000
  • Group Learning Sessions on Retirement Basics: ฿13,800 per person
  • Household Records Organisation Programme: ฿31,900

4.3 Payment

Payment is due at or before the first session, unless otherwise agreed in writing. We accept Thai bank transfer and cash. Details are provided in your booking confirmation.

4.4 Cancellations & Rescheduling

If you need to cancel or reschedule, please let us know as early as possible by phone or email. Cancellations made at least five working days before the session will receive a full refund. Cancellations made within five working days will not generally be refunded, though we will always try to find a suitable alternative date where we can. We reserve the right to reschedule or cancel a session due to unforeseen circumstances, and will offer a full refund or alternative date in such cases.

5. Client Responsibilities

To get the most from a session, you agree to:

  • Attend sessions at the agreed time and location, or give reasonable notice if you are unable to.
  • Provide accurate and complete information when discussing your records and situation.
  • Use session materials and content for your own personal, non-commercial purposes only.
  • Not reproduce, share, or distribute printed materials or session content without our prior written agreement.
  • Treat our staff with courtesy and respect at all times.

You also agree not to use our services or website to:

  • Seek advice on specific financial, legal, or tax decisions — we are not licensed to provide this, and any such questions will be directed to the relevant professionals.
  • Misrepresent your identity or circumstances.
  • Engage in any conduct that could harm Pensara or other clients.

6. Intellectual Property

All content on this website — including text, layout, graphics, and structure — and all session materials produced by Pensara are our intellectual property or are used under licence. They are protected by applicable copyright laws.

We grant you a limited, personal, non-transferable licence to use session materials for your own private household purposes. This does not allow you to copy, distribute, publish, or use the materials commercially in any way.

If you would like to share something from a session, please ask us first. We are generally happy to discuss this.

7. Disclaimers

Pensara's services are organisational and informational only. We help people understand and organise documents; we do not advise on financial planning, investment decisions, tax matters, legal rights, or any other regulated subject. For those matters, you should speak with a qualified professional or the relevant government body.

While we take care to present general information accurately, we do not warrant that all information provided in sessions or on this website is complete, current, or free of error. Requirements relating to retirement, pensions, and documentation can change, and official sources should always be consulted for the latest position.

This website and our services are provided on an as-available basis. We do not make any promises about specific personal outcomes arising from attending a session.

8. Limitation of Liability

To the fullest extent permitted by Thai law, Pensara's total liability to you for any claim arising out of these terms or our services will not exceed the amount you paid for the session giving rise to the claim.

We will not be liable for any indirect or consequential losses, including loss of opportunity, loss of income, or losses arising from decisions made based on information provided in a session.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for any other liability that cannot lawfully be excluded.

We are not liable for delays or failures caused by events outside our reasonable control, such as extreme weather, power disruptions, public health measures, or other circumstances beyond our ability to foresee or prevent.

9. Indemnification

You agree to hold Pensara harmless from any claims, costs, or losses arising from your breach of these terms, your misuse of session materials, or any inaccurate information you provide when booking or attending a session.

10. Termination

You may cancel a booking at any time, subject to the cancellation terms in Section 4.

We may stop providing services to you if you breach these terms in a material way and do not remedy the breach within a reasonable time of being asked to do so. In such cases, we will refund any amount you have paid for sessions not yet delivered, less any reasonable costs already incurred.

Provisions that by their nature should continue after any ending of this agreement — including those on intellectual property, disclaimers, limitation of liability, and dispute resolution — will remain in effect.

11. Dispute Resolution

These terms are governed by the laws of Thailand. Any dispute arising from them will be subject to the jurisdiction of the courts of Chiang Mai, Thailand.

We would always prefer to resolve concerns directly and informally. If you have a question or complaint about a session, please contact us first — most matters can be sorted out through a straightforward conversation.

If a concern cannot be resolved informally, either party may request non-binding mediation before commencing any formal proceedings.

12. General Provisions

Entire agreement. These terms, together with any booking confirmation, represent the complete agreement between you and Pensara and replace any earlier informal discussions.

Severability. If any part of these terms is found to be unenforceable, the remaining parts continue in full effect.

Waiver. If we do not enforce a term on one occasion, that does not mean we waive our right to enforce it in the future.

Assignment. You may not transfer your rights or obligations under these terms to another person without our written consent. We may transfer our rights and obligations, for example in connection with a business restructure, provided this does not reduce the rights you hold under these terms.

Notices. Written notices under these terms should be sent to the contact details in Section 14.

13. Changes to These Terms

We may update these terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will make reasonable efforts to notify clients who have active bookings.

Continued use of our website or services after an update takes effect constitutes acceptance of the revised terms. If you do not accept a change, please contact us before your next session.
